These Terms and Conditions govern your use of lunaheatingcooling.com and the services provided by Luna Heating Cooling LLC. Please read them before booking service or redeeming a promotion.

1. Agreement to These Terms

These Terms and Conditions ("Terms") govern your use of lunaheatingcooling.com (the "Site") and the heating, cooling, indoor air quality and related services provided by Luna Heating Cooling LLC ("Luna," "we," "us," or "our"). By using the Site, requesting or receiving service, booking an appointment, redeeming a promotion, or signing an estimate or invoice, you agree to these Terms.

If you have signed a separate written agreement with Luna, such as an installation contract, a maintenance membership agreement, or a commercial service agreement, that document controls where it conflicts with these Terms.

3. Services and Service Area

Luna provides residential and light commercial HVAC installation, repair, maintenance and indoor air quality services throughout the Kansas City metro in Kansas and Missouri. Service availability, response times and pricing vary by location, season and technician availability. We may decline or discontinue service to any property at our discretion, including where conditions are unsafe, the equipment is beyond service, or access cannot be provided.

4. Booking, Arrival Windows and Rescheduling

  • Appointments booked online, by phone or by text are requests until confirmed by Luna.
  • Arrival times are estimated windows, not guaranteed times. Emergency calls, weather, parts availability and job overruns can move a window. We will contact you if your window changes.
  • An adult 18 or older must be present at the property for the duration of the visit unless arranged otherwise in advance.
  • Please give at least [24] hours notice to cancel or reschedule. Missed appointments and same-day cancellations may be subject to a [$AMOUNT] fee.

5. Diagnostic and Service Call Fees

Repair visits carry a diagnostic fee, currently $95 for standard heating and cooling diagnostics. The fee covers travel and the technician's time to identify the problem and present options. It does not include repairs, parts or refrigerant. After-hours, weekend, holiday and emergency visits are billed at [RATE/SURCHARGE]. Current fees are quoted at the time of booking and confirmed before work begins. [State here whether the diagnostic fee is credited toward an approved repair.]

6. Estimates, Approvals and Change Orders

  • Estimates are provided in writing and are valid for [30] days unless stated otherwise. Pricing may change after that window based on equipment cost and availability.
  • Work begins only after you approve an estimate in writing or electronically. Your electronic signature or approval on a technician's tablet, and your acceptance by email or text, have the same effect as a signature on paper.
  • Estimates cover only the scope described. Conditions found after work starts, such as undersized or damaged ductwork, failed wiring, code violations, asbestos, mold, water damage, or structural and drainage issues, are outside the estimate and require a change order before that work proceeds.
  • Flat-rate pricing is based on standard installation conditions. Non-standard conditions may change the price.

7. Property Access, Safety and Site Conditions

  • You are responsible for providing safe, clear access to the equipment, electrical panel, attic, crawlspace and outdoor unit, and for securing pets during the visit.
  • Luna may pause or decline service where conditions are unsafe, including hazardous materials, gas leaks, standing water, pest or rodent infestation, blocked or unstable access, or animal aggression. A diagnostic or trip fee may still apply.
  • Some work requires moving stored items or accessing finished spaces. We take care around your home, but you should move fragile or valuable items out of the work area before we arrive.
  • Luna is not responsible for pre-existing conditions or for failures of components we did not instalzl or service, including drain lines, ductwork, electrical service, gas piping, and building envelope issues.

8. Payment Terms

  • Payment for repairs and service is due upon completion unless financing has been approved or other written terms apply.
  • Installations require a deposit of [AMOUNT/PERCENT] at signing, with the balance due at [substantial completion / startup].
  • We accept [cash, check, and major credit cards]. Card payments may carry a processing fee where disclosed in advance and permitted by law.
  • Past-due balances accrue interest at [RATE]% per month, or the maximum allowed by law, whichever is less. You are responsible for reasonable collection and attorney's fees on amounts we have to pursue.
  • Returned checks and failed payments are subject to a [$AMOUNT] fee.
  • Luna reserves all lien rights available under Kansas and Missouri law for labor and materials furnished.

9. Financing

Financing is offered through third-party lending partners, including GoodLeap and GreenSky. Luna is not a lender and does not make credit decisions. Credit check required. Approval, rates, terms and monthly payments vary based on qualification, loan amount and the lender's program. Any payment examples shown in advertising or on the Site are illustrative, assume a representative system cost and average credit, and are not an offer of credit. Promotional rate programs are set by the lender and can change or end at any time. Your loan agreement with the lender governs your financing.

10. Permits, Inspections and Code Compliance

Where required, Luna pulls permits and coordinates municipal inspections for installation work. Permit fees are included in your estimate unless stated otherwise. Inspection scheduling is controlled by the local jurisdiction, not by Luna. Work is performed to applicable codes in effect at the time of installation. Bringing pre-existing conditions in an older home up to current code is not included unless the estimate says so.

11. Rebates, Tax Credits and Utility Programs

Luna may identify utility rebates or manufacturer promotions you appear to qualify for and can assist with paperwork, but rebate and incentive programs are administered by third parties. Eligibility, amounts, deadlines and funding are set by those programs and change without notice. Luna does not guarantee any rebate, credit or incentive, and does not provide tax advice. Consult your tax professional about federal or state credits.

12. Warranties

Equipment

New equipment carries the manufacturer's warranty. Manufacturer terms, exclusions and registration requirements govern that coverage. Most manufacturers require registration within [60-90] days of installation for full term coverage. Luna [registers equipment on your behalf / provides registration instructions at completion].

Luna labor and workmanship

Luna warrants its workmanship on installations for [TERM] and its labor on repairs for [TERM] from the date of service. If a covered failure occurs, we will [repair or re-perform] the work at no labor charge during that period.

What is not covered

  • Parts or equipment supplied by the customer or by others.
  • Failures caused by lack of maintenance, dirty filters, improper thermostat operation, power surges, flooding, storms, pests, or work performed by anyone other than Luna.
  • Pre-existing ductwork, electrical, gas, drainage and structural conditions, and refrigerant loss from lines Luna did not install.
  • Cosmetic issues, noise typical of the equipment, and normal wear.
  • Accounts with an outstanding balance. Warranty service is suspended while an invoice is past due.

13. Disclaimer and Limitation of Liability

Except for the warranties stated in Section 12, Luna disclaims all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

To the fullest extent permitted by law, Luna is not liable for indirect, incidental, special, consequential or punitive damages, including lost income, spoiled food, hotel costs, mold remediation, or damage resulting from a system failure. Luna's total liability arising out of any service is limited to the amount you paid for that service. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Maintenance Memberships

  • Memberships are billed monthly at the rate in effect when you enroll and renew automatically until cancelled.
  • Included visits must be scheduled by the member and performed during the applicable seasonal service window. Unused visits do not roll over and have no cash value.
  • Member discounts apply to work performed while the membership is active and current, and cannot be combined with promotional offers unless stated.
  • You may cancel with [30] days notice by [phone / email / account portal]. [State whether prepaid amounts are refundable and whether a plan transfers to a new homeowner.]

15. Promotions and Special Offers

Luna advertises limited-time promotions from time to time through our website, email, direct mail and paid advertising. The terms in this section apply to every Luna promotion. Where an advertised offer states its own price, included services, eligibility or dates, those published details apply in addition to the terms below.

Eligibility

  • Promotions apply to owner-occupied residential properties, including single-family homes and multi-family units such as duplexes, provided the property is directly owned and occupied by the customer redeeming the offer.
  • Third-party managed properties, tenant-occupied rentals, property management accounts and commercial buildings are excluded unless the offer states otherwise.
  • Limit one offer per customer, per individual heating or cooling unit, unless the offer states otherwise.
  • Offers are void where prohibited and are not available outside Luna's service area.

Redemption

  • The promotion must be mentioned at the time of booking. Offers cannot be applied retroactively to work already completed or invoiced.
  • Service must be scheduled in advance and is subject to technician availability and, where applicable, the seasonal service window for that equipment.
  • Offers cannot be combined with other discounts, coupons, promotions or maintenance membership plan pricing.
  • Offers have no cash value, are not redeemable for cash or credit, and are not transferable.

What a promotion covers

  • Promotional pricing covers only the specific services or equipment described in the offer. Anything outside that description is quoted and billed at standard rates.
  • Unless the offer says otherwise, promotions do not include and cannot be applied toward repairs, parts, refrigerant, component replacement, emergency or after-hours service, major cleanings, or additional diagnostic work.
  • Equipment must be operational, accessible and in safe working condition at the time of service. Non-functional, unsafe or obstructed equipment may require standard diagnostic service at regular rates.
  • Installation offers assume standard installation conditions. Non-standard conditions, code corrections and system modifications are quoted separately.
  • Advertised prices exclude applicable taxes and permit fees unless stated.
  • Promotional financing is provided by third-party lenders and is subject to Section 9 and to credit approval.

Changes and expiration

  • Luna reserves the right to modify, suspend or end any promotion at any time without prior notice.
  • An offer advertised without a stated end date runs until Luna ends it. An offer with a stated end date, unit limit or other stated condition ends when that condition is met.
  • Work already scheduled at the advertised price before an offer ends will be honored at that price.

16. Communications: Calls, Texts and Recording

When you give Luna your phone number, whether by booking online, filling out a form, texting us, or providing it to a technician or customer service representative, you agree that we may contact you at that number about your service, including appointment confirmations, arrival notifications, technician dispatch updates, estimates, invoices and service follow-ups, using automated systems, prerecorded messages and text.

  • Marketing calls and texts are sent only with your consent, and consent is not a condition of purchase.
  • Message frequency varies. Message and data rates may apply.
  • Reply STOP to any text to opt out. Reply HELP for help, or call (913) 283-1018.
  • You may withdraw consent by any reasonable means, including replying STOP, telling a technician or representative, calling, or emailing emailsupport@lunaheatingcooling.com. We honor opt-out requests promptly and in no event more than ten (10) business days after receipt. Opting out of marketing does not stop transactional messages about work already scheduled or in progress.
  • Calls to and from Luna may be monitored or recorded for quality and training purposes.
  • Technicians may be dispatched with equipment that logs job location and timing. Photos of equipment and the work area are routinely taken for documentation.

17. Photos, Reviews and Customer Content

Luna photographs completed work for documentation, training and marketing. Unless you tell us otherwise in writing, you grant Luna permission to use non-identifying photographs of installed equipment and work areas at your property in marketing materials. We will not publish your name, street address or an image of the interior of your home for marketing without your permission. If you submit a review, testimonial, photo or video to Luna or to a public review platform, you grant Luna a non-exclusive, royalty-free license to reproduce and display it.

18. Website Terms and Content

  • Site content is provided for general information. Pricing, promotions, equipment availability and program details change and may not always be current.
  • Prices shown on the Site are estimates and are not a binding quote until confirmed in a written estimate.
  • Product photos are illustrative. Installed equipment may differ in appearance or model.
  • The Luna name, logo, Luna Series, Stellar Protection Plan, Polaris Smartstat, site copy, images and design are owned by Luna or its licensors and may not be copied or used without written permission.
  • The Site may link to third parties. Luna is not responsible for their content, products or practices.
  • You may not scrape, resell, reverse engineer, interfere with, or attempt unauthorized access to the Site.

19. Privacy

Personal information collected through the Site and through our service operations is handled as described in our Privacy Policy at lunaheatingcooling.com/privacy-policy, which is incorporated into these Terms by reference.

20. Force Majeure

Luna is not liable for delay or failure to perform caused by events outside our reasonable control, including severe weather, natural disaster, utility outage, labor shortage, manufacturer or supplier delay, equipment backorder, government action, or public emergency.

21. Dispute Resolution and Governing Law

If something goes wrong, contact us first at (913) 283-1018 or emailsupport@lunaheatingcooling.com so we can try to resolve it directly. Most issues are fixed with a phone call and a return visit.

These Terms are governed by the laws of the State of Kansas, without regard to conflict of law rules. [Any dispute not resolved informally within 30 days shall be brought exclusively in the state or federal courts located in [COUNTY], Kansas, and the parties consent to that jurisdiction.]

23. Other Terms

  • Severability: if any provision is found unenforceable, the rest remains in effect.
  • No waiver: our failure to enforce a provision is not a waiver of it.
  • Assignment: you may not assign your agreement with Luna without our written consent. Luna may assign in connection with a sale or reorganization of the business.
  • Entire agreement: these Terms, together with any signed estimate, installation contract or membership agreement, are the entire agreement between you and Luna on their subject matter.

Luna is not liable for delay or failure to perform caused by events outside our reasonable control, including severe weather, natural disaster, utility outage, labor shortage, manufacturer or supplier delay, equipment backorder, government action, or public emergency.

21. Dispute Resolution and Governing Law

If something goes wrong, contact us first at (913) 283-1018 or emailsupport@lunaheatingcooling.com so we can try to resolve it directly. Most issues are fixed with a phone call and a return visit.

  • Assignment: you may not assign your agreement with Luna without our written consent. Luna may assign in connection with a sale or reorganization of the business.
  • Entire agreement: these Terms, together with any signed estimate, installation contract or membership agreement, are the entire agreement between you and Luna on their subject matter.
